So I suspect they meet more often than a less populated area. The charge is for transporting a minor across state lines for sexual purposes. Grand jury proceedings are totally secret. The only people who can be present are the jury, a witness (while testifying), a sworn interpreter (if needed), the court reporter, a Grand jury clerk, and the prosecutor. It is unlawful for anyone else to be present, and it is unlawful for members of the jury or anyone else to discuss what takes place in the Grand jury proceedings. Grand jury testimony is usually released prior to trial so that the defendant has a transcript of the proceedings in his or her case only. Defendants do not have a "right" to testify at Grand jury, though they may be invited to testify if they wish to. They have an absolute fifth-amendment right not to testify. If they do choose to testify, they can consult with a lawyer outside the Grand jury room at any time, but the lawyer cannot be in the Grand jury room. The Grand jury usually only hears one side of the case, and that is the State's side. The State would have an obligation to present any evidence tending to prove the defendant is not guilty. The reason it is one-sided is that the purpose of the Grand jury is only to ensure that the State has sufficient evidence to formally charge the defendant with a crime. Answer: The 5th amendment basically, states that you do not have to incriminate yourself. So if you are on trial for something you do not have to testify, and say that you did it. What does it mean if you have to appear before a GRAND JURY?

How long does New York GRAND JURY duty take?

I got summoned for Grand jury duty in New York City. I am planning a trip around that time and I am wondering how long it takes? Has any one done this? I have read in different places that you serve only for a 4 week "term of court". Is this true?
Answer: Grand Juries have a whole different set of rules than others. A grand juror serves for how ever long the jury determines is necessary to handle the matters at hand. The point of a Grand jury, in New York law, is to make certain that someone charged with a capital offense should really be charged! (In medieval times the King would just say, "Off with their head" or "put them in the stocks" or something else on a whim. A Grand jury was a citizen body created to insure that real wrongs were done, not just a ruling elite setting arbitrary punishments.) This is from the NY state law: "A grand juror shall serve for the duration of the term for which the grand juror has been selected and for any period during which the Grand jury panel on which the grand juror has been serving is extended, unless sooner discharged." So, you'll serve for however long it takes to for you to be convinced that the accused is rightfully, or wrongfully accused.
