I am not gay, but I am an avid supporter of the right to be equal and marry whoever you want to marry. I read on a popular gossip blog that Prop 8 was passed and gay marriage is now banded in California. While this is devastating news to me and friends of mine, I was wondering what will happen to those who already married when gay marriage was Legal?
Answer: Prop. 8 This is going to be a hot bed issue for the next many, many years. I may not agree with all the principles of this bill, and I may agree with some, but I could never cast a vote that limits the rights of ANY minority group, regardless of whether or not I like them. I could never cast a vote that limits the civil rights of any man or woman, short of criminals. I believe that the United States took a major step backwards yesterday, back to the days of segregation based on creed and color. This is the first major step back we have taken since the 1950's and days of dogs and firehoses, sit-ins, and men like George Wallace blocking the education of young African Americans. For the first time in my life I am almost ashamed to call myself an American, how we could let this bill pass is beyond my realm of comprehension. We had enough sense to elect the best canidate, while he was black, but not enough to protect the rights of minorities in this country. This is a slippery slope we have begun to climb that can only end in disaster until we right this wrong committed against humanity. It doesn't matter whether or not you like gay people, or their lifestyles, but to say that one group/culture in America may not have the same rights as others is to say they are less than we are, and we have fought for 250 years to correct the incidences in our history where we have done this before, and now Americans are willing to do it in their own front yard, and stand against their neighbor and say, I am more deserving of happiness than you, and since your idea of happiness is different from mine, you may not have your happiness because I don't agree with it... How could Americans take such a step back in the struggle for social equality...I hope the religious right that aided in the passing of this bill enjoys praying for humanity, because we all volunteered a piece of our goodness yesterday and it is gone until we can correct this horrible wrong against our brothers and sisters... I for one, refuse to "TEACH" marriage as man and woman, I will teach love to all, not love for some, to be expressed in any way they see fit... Answer: GREAT point, but I think we all know the answer. White Christians are a "punching bag" in today's society meaning, you can't go wrong by protesting anything they do. There's no political fall from it. Blacks, on the other hand, are not so easily "protestable." If people were to protest outside of black churches, they might easily be branded as racists. If the federal courts uphold PROP 8, specifically what harm will that do to the gay marriage movement?

Some freak lawsuit was filed this week now taking Prop 8 to the federal courts. If the federal courts uphold Prop 8, what harm, if any, will that do to the gay marriage movement? A lot of lgbt groups are calling this move unwise and harmful to their own cause. Tell me, what are the consequences should the courts uphold Prop 8? Do they have anything to lose?
Answer: The LGBT groups that are calling this unwise are correct. The California Supreme Court ruled on a California law, and even though many people (including me) don't like it, it does make more sense to say that Prop 8 is an amendment, not a revision. I'm guessing that the federal courts will either refuse to hear the case, or uphold Prop 8. It won't harm the cause much, because Prop 8 can be repealed in 2010.

Why can opponents of PROP 8 get the results of the election overturned?

My question has little to do with ones stance on Prop 8. I just dont get how the result of the election can be overturned? If the court can reverse the decision made by the population then what is the point of an election? Perhaps campaign money should be spent on bribing judges instead of attempts to inform voters.

When PROP 8 is brought to the US Supreme Court, will the justices rule on their beleifs?

When Prop 8 is brought to the US Supreme Court, will the justices rule on their own personal opinion weather Prop 8 should be upheld, or would the ruling be based on in a prospective that California voters had a majority vote in uphelding Prop 8? Would this effect the marriage laws in Massachusetts for example?
Answer: First, it would have no affect on Massachusetts or any other State that allows gay marriage. This case is about whether or not a State ban on gay marriage is permitted under the Federal Constitution. Nobody is questioning whether or not a State is allowed, if it so chooses or if it is required by it's Supreme Court's interpretation of it's own State Constitution, to permit gay marriage. As for what will happen in the US Supreme Court, the question is whether Prop 8 violates the Constitution, particularly the equal protection clause of the 14th amendment. If it violates that clause, then it doesn't matter whether it was passed by executive order against public opinion or referendum with 100% of the vote. California cannot violate the US Constitution, no matter how badly they want to. If it doesn't violate the Constitution, then the Federal Government has no standing to overthrow the ban. The State Supreme Court already ruled that the procedure was valid under their State Constitution (a close question that I think was wrongly decided). The Federal Supreme Court cannot overrule the State Supreme Court on that question because it is a question of State law, not Federal law, and so this case is not posing that question. So the justices aren't using their own opinion vs. using the opinion of the California voters, they are interpreting the Constitution. The California voters don't get to change the Constitution. There is a procedure for that and it isn't a simple majority in California. They will decide, as always, based on their opinions of the Constitutional question being asked. As for how that decision will come out, here's my analysis (from my stock answer): Scalia, Thomas, Roberts, and Alito will undoubtedly vote in favor or Prop 8 (against gay marriage). Ginsberg, Breyer, Sotomayor, and incomming Justice Kagan will undoubtedly vote against Prop 8 (for gay marriage). The deciding vote will be, as usual, Anthony Kennedy. Let's have a look at his views on the matter, shall we: "Amendment 2, however, in making a general announcement that gays and lesbians shall not have any particular protections from the law, inflicts on them immediate, continuing, and real injuries that outrun and belie any legitimate justifications that may be claimed for it. We conclude that, in addition to the far-reaching deficiencies of Amendment 2 that we have noted, the principles it offends, in another sense, are conventional and venerable; a law must bear a rational relationship to a legitimate governmental purpose, and Amendment 2 does not." -Justice Anthony Kennedy, Majority Opinion, Romer v. Evans, 517 U.S. 620 (1996), holding an amendment to the Colorado Constitution invalid because it discriminated against homosexuals. I think it may be difficult for Kennedy, in the face of his own opinion from 14 years ago, to uphold Prop 8 now. While you never know for sure with him and his swing vote usually sides with the conservatives, Kennedy is a libertarian at heart and I hope and expect that his love of freedom wins out, which it usually does, even when he personally opposes the use of that freedom.

Answer: First of all, Prop 8 violated BOTH the Due Process AND the Equal Protection clauses of the 14th. Due Process Clause - obviously, the key word here is "liberty". Marriage has already been declared a fundamental human right by the US Supreme Court. A state has no legitimate government interest in denying that fundamental right to gay people. Judge Walker saw no rational basis for California to treat opposite sex couples as superior to same sex couples. Equal Protection Clause - Government simply cannot arbitrarily treat a defined group differently under the law UNLESS there is a legitimate, compelling reason to do so. Simple bigotry isn't sufficient.

I hear a lot of jargon about constitutional law, wherein neither the people nor the Legislature do not have the right to revise or adjust the California State Constitution, which is what Prop 8 does. Problem is that homosexuals want the term "marriage" to be changes. It's not a civil rights issue, it's a perception issue, and most people do not want the perception of marriage to be changed to include men-men and women-women. Frankly I could care less. Morally I could care less. But LEGALLY, there is no discrimination, no violation of rights, and frankly, had Proposition 22 be upheld it probably would have been overturned because it was simply a law. Now that 8 passed, it will be extremely difficult indeed to change the constitution.

And do you think that they could do that? Why is everyone acting like if Prop 8 passes in California that it will forever end gay marriages? Yes itd be a setback, but not the end. Instead, LGBT activists should start saving up money for another ballot initiative in 2010 to reverse Prop 8 and re-legalize gay marriage if the current Prop 8 passes.

i voted yes on this and would do it again. my question is this. why dont the gays go to a state where it is legal or get over it. i voted yes because they do teach marriage in public school, my 12year old brother has a text titled family life. if Prop 8 would have not passed he would learn about that. i dont care about other people, but in my family being gay aint cool.

One thing that angers me is how many people thing that those who voted for Prop 8( i being one of them) are hating or discriminating. Don't get me wrong, I'm sure a big part may be homophobic, but I'm not. I don't hate gays/lesbians... I have people in my family who are gay and lesbian whom I love!!!! Many black and whites couldn't marry. it became known that they all had the same right...bc God let it be known that all men are created equal!!!!!! You may ask, who are we to take the right of a couple in love to marry? Well have you ever thought that maybe it wasn't "our votes" that decided that. Maybe it was the Lord above..yes it sounds naive, but things happen for a reason. He clearly stated that marriage was between a man and woman..main reason is to procreate. “Haven’t you read,” he replied, “that at the beginning the Creator ‘made them male and female,’?a? 5 and said, ‘For this reason a man will leave his father and mother and be united to his wife, and the two will become one flesh’?b?? 6 So they are no longer two, but one. Therefore what God has joined together, let man not separate.” -Matthew 19:4-6 Obviously, the word of the Lord has been turned into shreds through the ages, but it is still something I believe in. If you were to look up the word marriage in a dictionary, it clearly states that it is "the social institution under which a man and woman establish their decision to live as husband and wife by legal commitments, religious ceremonies, etc." I don't think we can change the meaning of a word in the dictionary...very rare occurrance. People also argue about they “deny rights to marry, they should ban divorce!!” Divorce was illegal for a long time and why it passed who knows. Point is I don't believe in divorce either. Just like the true meaning of marriage states, it is a lifelong commitment. Of course, there are certain circumstances i.e. physical abuse, verbal abuse, etc. But all this we were too different and couldnt get along stuff and 55hr just for fun marriage is a bunch of bologne. “While the Bible doesn’t address the concept of gay or same sex marriage, the Bible does clearly and consistently tell us that homosexual activity is a sin (Genesis 19:1-13; Leviticus 18:22; Romans 1:26-27; 1 Corinthians 6:9). God does not create a person with homosexual desires. A person becomes a homosexual because of sin (Romans 1:24-27), and ultimately because of his or her own choice. A person may be born with a greater susceptibility to homosexuality, just as people are born with a tendency to violence and other sins. That does not excuse the person choosing to sin by giving in to their sinful desires. If a person is born with a greater susceptibility to anger / rage, does that make it right for them to give into those desires? Of course not. The same is true for homosexuality. AND YES WE SHOULD BE NON JUDGEMENTAL AND FORGIVING!!!!!! We also have to remember that homosexuality is just as forgivable a sin as all other sins. God’s forgiveness is just as available to a homosexual as it is to an adulterer, idol worshipper, murderer, liar, proud man, etc. God’s love and desire to save extends to homosexuals (John 3:16; Romans 5:8). God also promises the strength for victory over sin, including homosexuality, to all those who will believe in Jesus Christ for their salvation (1 Corinthians 6:11; 2 Corinthians 5:17). To give sanction to homosexual marriage would be to give approval to that lifestyle, which the Bible clearly and consistently condemns as sinful. I believe that Christians should stand firmly against the idea of gay marriage / same sex marriage. Marriage is ordained by God to be between a man and a woman (Genesis 2:21-24; Matthew 19:4-6). Homosexual marriage is a perversion of the institution of marriage and an offense to the God who created marriage. God forbids and condemns homosexuality, so He clearly is opposed to homosexual marriage. As Christians, we are to seek to share the love of God and salvation through Christ with homosexuals. We are to be loving and kind to homosexuals, while at the same time not condoning the

First of all I am a straight 20 year old male who if I lived in Calofrina would have voted aganist Prop 8. I dont know why people go out of their way to deny people rights. I do believe however that I church should not be forced to marry gays, because I believe that it is a religious cermony. Prop 8 is currently passing 52% vs 48% in California. What would be the result be if the whole nation voted on this issue? Prop 8 defines marriage as being between a man and woman only. I suppose if this passes in CA, it would pass everywhere.
